For sellers… the Queensland Government has made it necessary, from 1st December 2010, for sellers to arrange a Pool Fence Safety Inspection and obtain a Compliance Certificate to confirm your pool fence complies with new Pool Safety Legislation… or disclose to buyers and the CEO of the Pool Safety Council. Now you can get a Pre-Sale Pool Fence Inspection as soon as you list or even better, before you list.

For buyers… if you accept responsibility for getting the Certificate you have until 90 days post settlement to make the pool fence compliant.

For landlords… for a non shared pool associated with an accommodation agreement or lease, an exemption period applies from January 8th 2011 to July 8th 2011. A Pool Safety Certificate will be required at the first new or renewed accommodation agreement or lease signed after 8th July 2011.

During the exemption period, homeowners are not required to have a Pool Safety Certificate at the time the accommodation agreement is entered into. Once a Pool Safety Inspector has been engaged, the 90 day re-inspection period still applies.

Note:

  • Shared pools associated with short term accommodation (s291(1) the Building Act 1975) must have a Pool Safety Certificate by 31st May 2011.
